Welcome to Monarch Reserve

These Terms of Service govern your use of our website and services. By accessing or using our site, you agree to comply with these terms. If you do not agree, you may not use our services.

1. Services Provided

Monarch Reserve offers a range of creative and operational services to creators and brands, including but not limited to:

For Creators & Partners:

  • Design and creative direction for custom apparel and merchandise

  • Product development, including blank selection, sampling, and revisions

  • Apparel production and sourcing using third-party manufacturers

  • Custom store setup for limited-time drops and collections

  • Order and inventory management for creator campaigns

  • Fulfillment services, including packaging and shipping

  • Customer support related to product orders and fulfillment

  • Marketing support for launch strategy and product promotion

  • Revenue sharing or commission-based payout structures

For Customers (Buyers):

  • Purchase of limited-run apparel and merchandise through our online storefronts

  • Order processing, shipping, and tracking of purchased items

  • Customer support for product issues, shipping delays, and order inquiries

  • Access to limited-time drops and exclusive collections

2. User Responsibilities

You agree to provide accurate information and materials required for your project. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Payments

For Customers:

  • All prices are listed in USD unless otherwise noted.

  • Payment is required at the time of purchase. We accept major credit cards, debit cards, and other payment methods as listed at checkout.

  • Orders will not be processed or shipped until full payment is received.

  • Sales are final unless otherwise stated; please refer to our Return & Refund Policy for more details.

  • Taxes and shipping fees may apply depending on your location and will be calculated at checkout.

For Creators & Partners:

  • Payouts are typically made on a revenue-share basis, as agreed upon in individual contracts or campaign agreements.

  • Creator payouts will be issued after the campaign ends and all orders have been processed, typically within 14–30 business days.

  • Monarch Reserve covers the cost of production, fulfillment, and other agreed-upon operational expenses prior to revenue distribution.

  • Payment may be withheld or delayed in the event of order disputes, chargebacks, or other unresolved financial issues.

  • All payments to creators will be made via the agreed-upon method (e.g., bank transfer, PayPal) and require accurate, up-to-date payment information on file.

4. Intellectual Property

All content on this site — including but not limited to logos, designs, text, graphics, images, videos, and product mockups — is the property of Monarch Reserve or its partnered creators and is protected by intellectual property laws.

For Creators:

  • Creators retain ownership of their original artwork, logos, and likeness used in collaboration with Monarch Reserve, unless otherwise agreed upon in writing.

  • By entering into a merchandise collaboration, creators grant Monarch Reserve a non-exclusive, royalty-free license to use their provided content (including name, likeness, logos, and designs) for the purposes of product development, marketing, sales, and fulfillment related to the agreed-upon campaign.

  • Monarch Reserve may archive and display past work (including photos, mockups, and marketing materials) for portfolio or promotional use unless a written request for removal is submitted by the creator.

For Customers:

  • Purchase of merchandise does not grant you any rights to reproduce, distribute, or use the designs, logos, or content for any commercial purpose.

  • You may not copy, modify, or resell any part of the site or its contents without prior written consent from Monarch Reserve or the respective content owner.

Unauthorized use of any intellectual property associated with Monarch Reserve or its creators may result in legal action.

5. Prohibited Activities

To maintain a safe, respectful, and legally compliant environment for our creators, customers, and team, the following activities are strictly prohibited when using our website, services, or interacting with our content:

Users (Customers or Visitors) may not:

  • Use the site or its content for any unlawful purpose or to solicit others to perform or participate in unlawful acts.

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the site or products without express written permission.

  • Harass, abuse, insult, harm, defame, intimidate, or discriminate based on gender, identity, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

  • Submit false or misleading information or impersonate another person or entity.

  • Attempt to gain unauthorized access to our systems, interfere with security features, or bypass any measures put in place to restrict access.

  • Upload or transmit viruses or malicious code that could affect the functionality or security of our site or services.

Creators or Partners may not:

  • Submit infringing, stolen, or plagiarized content for production or promotion.

  • Misrepresent their brand, identity, or partnership status with Monarch Reserve.

  • Engage in behavior that could damage the reputation of Monarch Reserve or its affiliated partners.

  • Use Monarch Reserve's platform to promote harmful, discriminatory, or illegal messaging.

Violations of these terms may result in removal from the platform, cancellation of campaigns, legal action, or restriction of access to future services.

6. Limitation of Liability

To the fullest extent permitted by law, Monarch Reserve and its affiliates, directors, employees, agents, or partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our site, products, services, or any content provided — including but not limited to loss of profits, data, goodwill, or other intangible losses.

This applies whether the claim is based in contract, tort, negligence, strict liability, or otherwise, even if Monarch Reserve has been advised of the possibility of such damages.

We do our best to ensure a smooth experience, but we make no guarantees that the site will be uninterrupted, error-free, or fully secure at all times. Use of our platform is at your own risk.

In no case shall Monarch Reserve’s total liability exceed the amount you paid us for the product or service giving rise to the claim.

This includes, but is not limited to:

  • Breach of contract or violation of our policies

  • Fraudulent, abusive, or illegal activity

  • Behavior that negatively impacts creators, customers, or the Monarch Reserve brand

If you wish to terminate your relationship with us as a creator or partner, you may do so by providing written notice. Monarch Reserve may retain the right to archive past work for portfolio or promotional use unless otherwise requested.

Termination does not limit or waive any rights or obligations incurred prior to the date of termination, including payment responsibilities, intellectual property rights, or limitations of liability.

8. Amendments

Monarch Reserve reserves the right to update, modify, or replace any part of these Terms of Service at any time. If changes are made, we will post the updated terms on this page with a revised effective date. It is your responsibility to check this page periodically for updates.

Continued use of the site or our services following any changes constitutes acceptance of those changes.

If the amendment materially affects an active creator collaboration or agreement, we will make reasonable efforts to notify the parties involved directly.
